Dad won't face murder trial for killing mother of his children during row on date

A dad who admitted killing his partner during a row on date night won't be sentenced for murder.

Lloyd Birkby, 26, accepts he killed Levi Ogden, also 26, but insists his act was manslaughter.

A court heard the mum's grief-stricken family and the Crown Prosecution Service accepts this plea and won't try Birkby for further offences, including murder.

Yorkshire Live says the defendant will be sentenced for the manslaughter, and common assault of another woman, next month.

He appeared before Bradford Crown Court via a video link to HMP Leeds to enter the plea today.

The couple's date night in Halifax, West Yorkshire, turned ugly in November last year, Dafydd Enoch QC, prosecuting, said.

But he added he prosecution intended to offer no evidence on the murder charge.

Stephen Wood QC, defending, told the court a psychologist’s assessment of father-of-two Birkby was ongoing.

The defendant, of Elland, West Yorkshire, was remanded in custody ahead of sentencing on April 8.

Judge Jonathan Rose said: “You know full well a custodial sentence will follow."

Ms Ogden had posted on social media hours before the attack saying: "Date night. First one in forever."

She was dashed to hospital after the altercation in Halifax but died hours later.

Friends called her "a true, kind-hearted soul" and "a beautiful, caring, young person".
