A father and son accused of assaults in an East Kilbride pub have walked free after a witness twice failed to attend court.
Andrew Connelly, 67, and Andrew Gary Connelly, 34, both of Lochranza Drive, East Kilbride, were alleged to have attacked two men in the Oyster Catcher, Lindsayfield, on August 26, 2018.
The charges stated that the men were punched and kicked on the head and body during a "violent struggle".
Both accused denied the charges and trial was due to take place at Hamilton Sheriff Court this week after being postponed four times.
The prosecution witness who failed to show had previously said he was self-isolating because of Covid-19.
This time a warrant was issued for his arrest.
Solicitor Jackson Bateman, who represented Connelly senior, opposed a Crown bid to have the case adjourned.
He stated: "The court must balance the interests of justice with those of the accused.
"My client has no previous convictions and it's been very trying for him to be facing these charges."
The Crown's request for more time to track down the missing witness was refused and the case against both men was dropped.
