The Tokyo District Court on Tuesday approved the release on bail of Greg Kelly, a former representative director at Nissan Motor Co.
The Tokyo District Public Prosecutors Office appealed the court decision on Kelly's release earlier on the day, but the court dismissed it. Bail has been set at 70 million yen, which Kelly's side has paid.
The conditions of Kelly's release included that he will stay in Japan and be prohibited from leaving the country, according to the court.
Kelly, 62, has been detained at the Tokyo Detention Center on suspicion of violating the Financial Instruments and Exchange Law by underreporting the remuneration of Carlos Ghosn, 64, the company's former chairman, in securities reports.
Kelly has denied the charges, according to his attorney.
