A man and woman were filmed having sex in broad daylight on Swansea beach as others used the beach seemingly oblivious to what was going on.
A video seen by WalesOnline shows the pair engaging in sexual intercourse while people use the beach no more than a few metres away. The couple had apparently attempted to conceal themselves in grass between the sand and flats behind but there were clearly visible, including from the many flats in Swansea Marina that overlook the beach near the Swansea Observatory.
Children and families can be seen playing on the beach, apparently oblivious to what was happening, barely concealed, in the grass. Both people involved had stripped completely naked and seemingly couldn't contain themselves until they got home.
There are a number of laws that could result in this behaviour being considered illegal and result in arrest, such as outraging public decency contrary to common law, behaviour that is likely to cause harassment, alarm or distress to others contrary to the Public Order Act 1986, and offences of exposure.
Is having sex in public illegal?
Not all outdoor sex is automatically a criminal offence, particularly if there is a reasonable expectation of privacy. However a busy beach in broad daylight is hardly a place you can consider private so if the couple had been caught by police they could have been in real trouble. In 2018 four people were filmed having what appeared to be group sex in Bute Park in broad daylight on Friday afternoon. The police said the people involved were "vulnerable for a number of reasons".
