Counter-terrorism police arrest man accused of breaching control order

New South Wales police have charged a 21-year-old man with breaching the terms of a control order.

Ahmad Naizmand was charged on Tuesday with five offences relating to breaches of the control order he was placed on.

Control orders allow a person suspected of terrorism-related activities to have strict conditions placed on their movement and associations with others, but require a much lower standard of proof than criminal offences.

Naizmand’s order was the first confirmed control order in more than eight years. It follows agreement by the Australian federal police to a series of amendments to the order, making the restrictions it imposes more flexible.

The changes allowed Naizmand to use a phone and have internet access on a device specified by the AFP. It also lifted restrictions on which mosque he could attend.

It still placed heavy limits on the types of material he could access and also includes a list of people he was not allowed to contact.

The Australian federal police said: “On Monday 29 February 2016, the NSW joint counterterrorism team arrested a 21-year-old man.

“The man was charged with five counts against section 104.27 of the criminal code, namely ‘offence for contravene a control order’.

“As this matter subject to ongoing court proceedings, no further comment will be made at this stage.”

Naizmand is scheduled to appear before court on Tuesday in Burwood.

His control order is the first of four that have been sought over the past 18 months by the federal court.
