Class action launched over SA bushfire

A class action has been launched in the South Australian Supreme Court on behalf of people impacted by a major bushfire in the state's southeast in January.

The blaze at Lucindale burnt through 14,000 hectares and impacts about 70 properties.

Regional Victorian firm, Maddens Lawyers said the fire was alleged to have started after a burn-off pile ignited on a day of total fire bans and had then spread to neighbouring properties amid extreme weather conditions.

The court action has been issued against executors of the estate of Thomas Brinkworth and his surviving wife Patricia Brinkworth who own the land where the blaze ignited.

Maddens Lawyers Class Action Principal Kathryn Emeny said the launch of court proceedings was an important step in obtaining compensation for all community members impacted by the fire.

"This was a very significant fire event. The damage caused by the fire is far reaching and still being felt to this day," she said in a statement.

Claims for compensation will include all losses including fencing, trees and pastures as well as the time and cost spent clearing and restoring each property.

Claims will also be made for psychological injuries, and people are being invited to participate on a no-win, no fee basis, Ms Emeny said.

Maddens Lawyers is already involved in other class actions in South Australia, including one on behalf of victims of the 2019 Cudlee Creek fire in the Adelaide Hills and one for those impacted by the 2019 Yorketown fire on Yorke Peninsula.
