Carer who sexually assaulted man after barbecue told to 'pack and leave' by shocked wife

A carer who sexually assaulted a man after a barbecue has today been spared jail.

Colin Brown, 60, admitted committing the sexual offence to his wife - who then threw him out.

As he entered the dock at Liverpool Crown Court today Brown, of Laurel Drive in Eccleston, St Helens, wore a red t-shirt and black jeans and held a small black suitcase.

The court heard that the victim, who cannot be identified for legal reasons, did not remember the assault taking place.

Peter Killen, prosecuting, explained that after Brown admitted committing the offence to his wife she was "shocked" and "told him to pack and leave".

The court heard that Brown has no previous convictions.

Philip Astbury, defending, asked the judge to impose a community order as per the recommendation on a pre-sentence report and the court heard Brown is "effectively a carer".

Judge Anil Murray, sentencing, detailed that the victim was "particularly vulnerable" due to personal circumstances.

Judge Murray explained that the prosecution had considered charging Brown with a more serious offence of rape, but they "couldn't sustain that charge".

Paraphrasing a pre-sentence report the judge said: "You don't fully understand how you're responsible. That is a failing on your part."

Judge Murray also stated Brown is a "low risk of reconviction" and "is willing to work with professionals" to address his issues.

The judge handed Brown a community order for two years with 60 Rehabilitation Activity Requirements.

The judge explained that given the length of the community order he did not impose unpaid work.

A five-year restraining order was imposed and Brown was ordered to pay £500 in costs as well as a victim surcharge.
