Care worker warned after sending child messages with 'sexual references' as part of "inappropriate relationship"

An Ayrshire care worker has been reprimanded after he developed an “inappropriate relationship” with a vulnerable child previously under his care.

John Cherry “abused” his position of trust when he sent private Facebook messages to the child that were deemed to contain ‘sexual references.’

The governing body, the Scottish Social Services Council (SSSC), said Cherry’s behaviour fell “well below” the standards expected of a senior practitioner.

The governing body said the incidents took place on or around 29 January 2022, while Cherry, from Irvine, was employed as a Senior Practitioner at Orchard Cottage Care Ltd, on Byepass Road, Dundonald.

Cherry, whose town of employment was listed as Kilmarnock, previously supported the young person, known only as ‘AA,’ at Spark of Genius (Training) Ltd residential care, which has bases throughout Ayrshire.

He sent messages to the child after they told him they had been outside, in their pyjamas, at midnight, to “meet someone.”

Cherry’s responses to the messages were said to imply that the young person had been engaging in ‘sexual activity’ and, as a result, his comments were “inappropriate.”

In their report, SSSC Fitness to Practise Panel said to Cherry: “Your behaviour is serious. You have developed an inappropriate relationship with a vulnerable young person who you previously provided support to.

“The communication you sent to the young person would imply that you were referring to AA being involved in some form of sexual activity.

“Your behaviour is completely inappropriate and would not be expected of a social service worker.

“You have abused your position of trust by using this type of language when communicating with AA.

"You have crossed professional boundaries by commencing an informal relationship with AA. You have breached the trust and confidence AA placed on you as a social service worker.”

The governing body also claimed that Cherry “failed to show insight and remorse” for his behaviour and if he were to repeat this type of behaviour then vulnerable young people in his care could be placed at “a risk of emotional and psychological harm.”

Cherry also “failed to recognise” how his comments may have impacted on the child’s wellbeing.

The report said: “Social service workers should protect young people in their care from inappropriate sexual relationships. Your (Cherry’s) behaviour falls well below the standards expected of you as a Senior Practitioner.”

Cherry was handed a warning to be placed on his registration for two years and conditions imposed on his practise.
