Can same-sex spouse get OCI tag: Delhi high court to Centre

NEW DELHI: The Delhi high court sought on Tuesday the Centre’s response to a petition to allow the foreign-origin spouse of an Overseas Citizen of India cardholder to apply for OCI registration regardless of gender or sexual orientation.

The petition seeks a declaration that the right to legal recognition of same-sex marriage is a fundamental right.

The petitioners told the HC that they were married in New York in 2012.

Since one spouse wished to apply for OCI status in order to be entitled to a lifelong multiple-entry visa for India, the couple approached an activist to file RTI applications to ascertain the legal position on the spouse’s eligibility.
