A busker has pleaded not guilty to allegedly raping an intellectually impaired woman, he found in a park and then took to his home, while she was heavily drunk, passed out and unable to consent.
Wallace Nya Quoibia, 54, of Campbell, appeared from custody in the ACT Magistrates Court on Friday. He entered a plea of not guilty to a charge of engaging in sexual intercourse without consent.
The man was previously denied bail in December.
Magistrate Robert Cook adjourned to case to March 1 for a prehearing mention at the ACT Magistrates Court.
Legal Aid duty lawyer Stephanie MacGougan entered the plea on Mr Quobia's behalf.
In court documents, police state Mr Quoibia's alleged victim went to Mooseheads in Civic on December 4, 2021.
They say the woman had already consumed a number of alcoholic drinks, and remembers sitting beside a fireplace while drinking more in the nightclub.
"[The woman] has no further memory of the evening," the police documents state.
"The next thing she remembers is waking up briefly in a bed with a man on top of her having sex."
The police documents state "the sex was not consensual" as the woman was sleeping, and passed out again shortly after waking up.
Police allege that man was Mr Quoibia, who lives at Ainslie Village in Campbell.
According to investigators, he later introduced himself to the woman as Wallace, "said things that made [the woman] uncomfortable" and told her he had found her, passed out, in Glebe Park.
"He said multiple times he couldn't leave her there," police allege.
"Wallace also said that he loved her."
Investigators executed a search warrant at Mr Quoibia's home and spoke to him about the rape allegation on December 10.

Facts state Mr Quoibia told police he was walking home at around 2.30 to 3am after busking outside Mooseheads when he heard the alleged victim "swearing and cursing" in Glebe Park.
Mr Quoibia claimed to have helped her off the ground and hailed a taxi to take her back to his place because "he thought he could not leave her there".
He said that once they arrived, she tried to kiss him but he told her to sleep while he played a game on his mobile phone until she woke up.
Mr Quoibia told police he did not have sexual intercourse with the woman and that "if anyone was sexually assaulted, it was him".
He said he thought she had only made allegations against him because there was a rumour going around Canberra about him being a rapist and a paedophile.
