Bus driver who collided with biker found not guilty of causing death by careless driving

A bus driver accused of causing the death of a motorcyclist who smashed into his bus at 40mph has been found not guilty of causing death by careless driving.

Charles Deabreu, 65, was behind the wheel in Cardiff Bay on April 3, 2020, when he turned right into a side street near Techniquest as Michael Clark was approaching.

The 34-year-old slammed on the brakes of his motorbike but was unable to avoid the crashing in to the bus, hitting the vehicle's doors between 37mph and 41mph. He was later pronounced dead at the scene.

Experienced bus driver Deabreu denied causing death by careless driving after trial at Cardiff Crown Court was told by the Crown he should have seen the bike coming.

But the defendant's defence argued Mr Clark had been riding too fast in the moments leading up to the fatal crash.

The court also heard that prior to the crash Mr Clark had been travelling up to speeds of 76 mph. A post-mortem also revealed that he had cocaine in his bloodstream.

A jury took less than hour to deliver a not guilty verdict on Thursday and Deabreu, of Brynfedw, Pentwyn, was told by Judge Richard Williams he was free to leave the court.

The judge thanked members of the jury for their service.
