Brute used mobile provided by Scots prison bosses to threaten ex

A brute jailed for domestic violence used a mobile phone provided by Addiewell prison bosses to bombard his ex with threats.

She received 126 phone calls from Brian Smyth on one day alone, a court heard.

Smyth also made repeated calls to Kelly McCusker’s daughter from his West Lothian jail cell.

The Scottish Tories called it “shocking”.

Every inmate in Scotland got a mobile last year to contact family after Covid put restrictions on visits.

The Scottish Prison Service said safeguards were in place to ensure it was not abused.

But Hamilton Sheriff Court heard he rang McCusker and Caitlin Lawley daily despite his ex asking jail bosses to have her number removed.

Smyth, 33, of Stonehouse, Lanarkshire, was put under supervision for two years and ordered to attend a domestic abuse programme.

He was also electronically tagged for three months and given a two-year non-harassment order, banning him from any contact with his ex-partner.

The SPS was contacted for comment. HMP Addiewell suggested it was an illegally-held phone.
