Brothers convicted of murdering partner, dumping body in boot, win retrial

Brothers Ambrose and Xavier Clarke were convicted in 2013 of murdering Perth businessman Peter Davis.

The Western Australian Court of Appeal has ordered a retrial for two brothers convicted of murdering a Perth businessman nearly seven years ago.

Ambrose Clarke and Xavier Clarke allegedly lured Peter Davis, 57, to a Malaga business in May 2011 and attacked him before wrapping his body in black plastic.

Mr Davis was then driven to a Rivervale motel where he was left to die in the boot of his four-wheel-drive.

Ambrose Clarke had been in business with Mr Davis but the relationship soured and he claimed Mr Davis owed him $300,000, which he would not pay.

The brothers faced a seven-week trial in 2013, with jurors finding both men guilty after about three hours.

They were sentenced to a minimum of 18 years' jail.

But today, the Appeals Court ordered the Clarkes' murder convictions be set aside and that both men stand trial again.

The reasons have been suppressed.

Outside the court, Monique Bertino-Clarke welcomed the verdict on behalf of her brothers.

"Prayers have been answered today," she said.

"Today's result is another step closer to proving Xavier and Ambrose's innocence.

"We are hoping that then, finally, Ambrose, Xavier and their families can live their lives safely and with proof of their innocence.

"We're going to focus our fight to get our brothers justice."
