BRIEF: Illinois lawmakers look to prevent state from suing inmates to recoup costs

March 02--The state would no longer be allowed to sue current and former prisoners to recover the costs of room and board related to their incarceration under legislation a Senate committee endorsed Wednesday.

The measure follows a late November Chicago Tribune examination of the practice that highlighted the struggles of inmates who were sued after coming into money, such as receiving modest inheritances and in one case, after successfully suing the Illinois Department of Corrections.

Under the measure, Illinois Attorney General Lisa Madigan's office would no longer be able to sue prisoners with assets. Madigan previously has said in a statement that the lawsuits raise "moral" questions and should be evaluated by lawmakers.

The cases are referred to her office by the corrections agency, which does not oppose the bill, said sponsoring Sen. Daniel Biss.

"A lot of people were surprised to learn this is something that can and does happen," said Biss, D-Evanston. "I believe it's inconsistent with the principles on how we should be funding government, and it's hugely counterproductive for people who are trying to get themselves back on their feet."
