Boozed up yob dropped his trousers at supermarket staff

A drunken lout exposed himself to supermarket workers and launched a volley of verbal obscenity at them before revealing his genitals a second time from outside.

Daryl Mark Kirby, 33, of New Albert Terrace, Runcorn, caused outrage at the store, also in Runcorn, on June 2, 2019, after aggressively arguing with a member of staff, Chester Crown Court heard today.

The scene unfolded in front of shoppers including adults and children, but Recorder Paul Reid, QC, accepted Kirby's claim the motive was to "insult" the staff rather than for sexual gratification.

Recounting Kirby's moment of shame, Recorder Reid said: "You dropped your trousers and exposed your penis and testicles and shouted at them 'suck my f***ing d*** you b****'.

"You went outside and dropped your trousers again."

Brian Treadwell, prosecuting, said Kirby had been "aggressive" and "belligerent" in the store and when outside banged on the window with enough force for those inside to think it might come through.

The doors were locked to protect those inside the store and police were called, who found Kirby had a bike cog taped up to allow its use as a weapon, described in magistrates' court papers as a "knuckle duster".

He pleaded not guilty to the charges but was convicted at Chester Town Hall, where trials are taking place due to Covid-19, on December 2, of indecent exposure and possessing an offensive weapon.

Kirby claimed the adapted bike cog was not his and he only had interest in it for use on a bike.

Simon Christie, defending Kirby, said the offences were 18 months ago and his client’s last convictions were 10 years ago.

He stressed there was no sexual motive, telling the court: "It was an insulting exhibition rather than a sexual exhibition."

Mr Christie added Kirby had "ongoing difficulties" and had lost his father in the last 10 years.

He said the defendant had also independently taken action to cut his alcohol consumption as he urged the court to "step back" from sending him to prison.

Kirby also suffered an injury to his arm during his arrest, Mr Christie said, and an MRI scan before Christmas showed his ligaments would need "to be repaired" this year.

Recorder Reid sentenced Kirby to a 24-month community order with 30 days of rehabilitation and an £85 victim surcharge to pay.

Regarding the motive for the exposure, he said: "So far as the exposure is concerned, I accept it wasn't a sexual gesture, it was just an insulting gesture."

Kirby must also sign the notification requirements, more commonly known as the Sex Offenders Register, for the next five years.

An order was made for the adapted bike cog weapon to be destroyed.
