The Madras High Court on Friday quashed an order passed by the Greater Chennai Commissioner of Police on October 23 detaining R. Kalyanaraman of the Bharatiya Janata Party (BJP) under the Goondas Act for his social media posts that were reportedly not conducive to the maintenance of communal harmony.
Justices P.N. Prakash and A.A. Nakkiran allowed a habeas corpus petition filed by the wife of the detainee and quashed the detention order. In her affidavit, the petitioner had said this was the second preventive detention order that had been slapped against her husband, and it ought to be quashed.
Her counsel R.C. Paul Kanagaraj pointed out that the first detention order was passed for a public speech made by him whereas now he had been detained on the basis of cases booked for his social media posts.
