The Bills do not expect pass rusher Von Miller to be put on the Commissioner’s Exempt List following his arrest for domestic violence, general manager Brandon Beane said Wednesday, per NFL Network’s Ian Rapoport. That means it would be Buffalo’s decision whether Miller will play this week vs. the Chiefs.

Beane added that the team will follow the NFL’s investigation and the legal process regarding Miller. However, formal charges have yet to be filed.

Miller is not expected to be placed on the Commissioner’s Exempt List.

Miller turned himself in on Nov. 30 to the Glenn Heights, Texas, police department after facing an arrest warrant for allegedly assaulting his pregnant girlfriend. According to an affidavit obtained by The Dallas Morning News, Miller grabbed his girlfriend’s hair and applied pressure to her neck during an argument. When she threatened to record the incident and call the police, Miller left the apartment.

The 34-year-old was booked in DeSoto Tri-City Jail before he posted bond and was released. Buffalo had a bye last week, and Miller rejoined the team Wednesday for the team’s first practice of the week.
