BBC fined £28,000 for broadcasting High Court case recording on the news

The BBC has been fined £28,000 for contempt of court for broadcasting footage from a High Court case on the news.

The penalty related to a BBC South East report in November which showed a six-second clip of a judge during a judicial review.

During a contempt of court hearing last month, the High Court heard how the BBC was granted access to a hearing which was being held virtually due to coronavirus restrictions.

The court heard the hearing, which related to a Surrey County Council planning decision, had been recorded by a BBC employee and a six-second clip was later played during two news reports on BBC South East.

The clip was featured in both the 6.30pm and 10pm news reports on BBC South East.

Contempt of court laws state it is illegal to record court proceedings or publish them and breaches can be punished with fines or even prison sentences.

During the contempt of court hearing, Mr Justice Warby told the court: "It seems to have been some sort of collective brain freeze about what was going on here and what was allowed."

Trevor Burke QC, for the BBC, told the contempt hearing: "There's no satisfactory explanation or reasonable excuse how this arose.

"It's plain with the benefit of hindsight, and should have been obvious, this simply shouldn't have happened.

"A number of people accessed and compiled the story while broadly aware of the law of contempt, and simply did not join up the dots...

"One would like to think if one voice was raised, the penny would have dropped and there would have been a quick realisation.

"But unfortunately no one raised their hand and said 'are we allowed OK in doing this?'"

Mr. Burke also told the court the BBC has launched an internal investigation.
