BBC EastEnders viewers spot storyline error in Phil Mitchell plot

BBC EastEnders character Phil Mitchell is in hospital and could be left brain dead after being badly beaten.

The Walford police have been investigating who could possibly be the culprit and they have a few names on their list.

While they questioned Keanu Taylor, played by Danny Walters, they pay a visit to Ben Mitchell - Phil's son - played by Max Bowen.

They point to their strained relationship and then say they are going to need to take some fingerprints.

But avid fans of the show were quick to point out that, given Ben's troubled past, the police should already have his prints on file.

Twitter user @gavinta83666688 said: "Ben's fingerprints should already be in the database ??? Somebody's made an error??"

Another, @dougie_winter said: "Surely they already have Ben’s fingerprints on file.."

A third, @Shaz_shiraz said: "Ben has been arrested and banged up more times, than I've had hot dinners and the Police are asking him for fingerprints?"

In the UK, the police can only keep fingerprints for three years, but they can keep them indefinitely if you are convicted of a crime under the 'Qualifying Offence' clause of the Data Protection Act - these include murder, manslaughter, rape and assault.

And this is likely to be the case with Ben, given that he was sentenced to four years in prison in 2012 for the manslaughter of Heather Trott, played by Cheryl Fergison.

EastEnders was contacted for comment.
