A banned gambler's attempt to win back $950,000 she lost at Sydney's Star casino has been thrown out of court.
Beauty therapist Kim Nguyen sued The Star accusing the casino of banning her, withdrawing her membership for no reason and making misleading statements to the police.
The Fairfield East woman claims she received a verbal one-year ban without an end date in April 2021. She says she did not dispute the ban at the time because of COVID-19 and family issues.
Also prevented from starting a job as a travel host at the casino, Ms Nguyen launched the NSW Supreme Court action seeking to overturn the ban.
As well as wanting to return to the casino to recover $950,000 in losses, she allegedly had $2500 of credit left which was not fully refunded when stripped of her membership.
She was not legally represented in court, but her partner spoke on her behalf.
In a judgment on Monday, Associate Justice Joanne Harrison said Ms Nguyen was advised a number of times that she did not have a viable cause of action and she had the opportunity to seek legal advice but did not do so.
"This Court is prohibited by legislation from granting relief in relation to an exclusion order," the judge said.
She decided not to exercise of her discretion to give Ms Nguyen another opportunity to replead her statement of claim "as she does not have a viable cause of action".
Her case was dismissed and she has to pay The Star's costs.
