Backlash to takeaway's 'unacceptable' plans to open until 4am

Neighbours and councillors have hit back at proposals for a Smithdown Road takeaway to stay open until 4am, warning it will worsen problems with waste, noise and anti-social behaviour.

Carlito's currently opens until 1am but has applied to the council to extend its operating time by three hours.

However, there have been a host of objections to the plans, including from the city's own licensing authority.

Neighbours who have submitted objections to the council say the plans will cause noise and anti-social behaviour to stretch well into the early hours of the morning.

One wrote: "As residents just off Smithdown Road we frequently suffer from late night noise and disturbances from the many take aways on Smithdown and local pubs at closing time.

"In addition we have a constant litter problem which is almost entirely from takeaways.

"To have alcohol served/available after midnight is only more likely to increase these issues in a residential area and is unacceptable."

Another said a later opening would increase problems with rubbish on nearby residential roads, as well as echoing concerns about noise and anti-social behaviour.

They said those issues already cause "great stress and inconvenience to residents".

A spokesman for Carlito's said the current owners only took over the licence in February of this year and said they had not seen any incidents of anti-social behaviour in the shop since then. He said the extension was necessary for the shop to continue to be a successful business and employ its staff.

He said: "I always pay my taxes and am trying to do my best for the business, which is very hard to manage. I have to think about the workers and about the quality of the food we serve to the clients.

"I don't make any compromise with that . I am trying to keep the high standard of the shop as it is aways been . Our shop is aways clean and tidy."

Ward councillors for the area have also objected to the plans.

Councillor Laura Robertson-Collins, who represents Greenbank ward, said: "It is not appropriate to trade all night and there is an agreed ‘curfew’ of 12am with police, council and businesses.

"499 Smithdown does not have planning permission to operate until 4am and would be doing so unlawfully. It has applied previously for this and been refused.

"Councillors and residents have already taken the time to express their concerns about this and this should be respected.

"This is a densely–occupied residential area, with families with children and older people living here.

"People live immediately above, behind and next to all the trading premises including 499 Smithdown.

"The area is plagued already with noise and anti-social behaviour issues, costing a great deal in public funds from police, council staff and councillors input to deal with this."

Fellow ward councillor Laurence Brown also said there were already issues on Smithdown Road with takeaway customers parking up on the pavement illegally and said this would worsen if Carlito's was allowed to open later.

In the council's own licensing authority objection, licensing officer Graham Cameron warned that the later opening "will inevitably give rise to noise nuisance at a time when nearby residents can be expected to be sleeping or attempting to go to sleep".

He said: "Such noise nuisance can reasonably be expected to take the form of customer’s car doors slamming, car horns being sounded and engines revving as well as customers arriving on foot congregating outside and talking and behaving noisily."

The Carlito's spokesman said Smithdown Road was a busy route and that noise nuisance would affect the road regardless of whether or not the shop was open

He said: "The noise in the area is probably disturbing to the neighbours but Smithdown is one of the busiest roads [in the city] and traffic is aways heavy even night time.

"We would like to work together with the council in all aspects. We would like the council to put bins outside and to restrict the parking of the cars in front of the shops on the foot path."

Liverpool Council's licensing and gambling sub-committee will decide on the application next Friday.
