Ayrshire man made shameful racist comments

Thomas Brown was also heard by other witnesses uttering racist comments to describe the woman’s fiancé as a “n****r.”

The vile abuse continued when he challenged the man to a fight and said he should “f**k off back to Africa.”

First offender Brown, 60, of Mill Square, Catrine, appeared at Ayr Sheriff Court on Tuesday, October 8. He admitted acting in a racially aggressive manner which caused, or was intended to cause, alarm or distress to Shimeon Beckles.

Brown repeatedly uttered racial remarks, did shout, swear and act in an aggressive manner and challenge Mr Beckles to fight.

The offence took place in Mill Square, Catrine, between July 23 and July 24, both dates inclusive.

Fiscal Depute Ms Carey told the court how the complainer and his girlfriend were engaged to be married. The accused lived directly across from the complainer.

Ms Carey said: “The complainer’s girlfriend was standing outside having a cigarette when the accused told her she should not be getting married as he was black.”

She then informed her partner.

“The complainer took umbrage and wanted to speak to him (Brown) but was talked out of it,”said Ms Carey.

The pair instead looked out a window, saw the accused and challenged him about the comments.

“The accused was very argumentative and challenged the complainer to a fight, saying ‘Come down here and I’ll show you,” said Ms Carey.

Another witness heard Brown say the victim was “nothing other than a n****r.”

Ms Carey continued: “Another witness heard the accused saying: “He’s a f*****g n****r. And he should f*** off back to Africa.”

Defence solicitor Ian Gillies said in mitigation his client had health problems and was on medication.

He said “This came out of nowhere. The problem is he can’t remember doing it. This day he had taken alcohol on top of his medication but the doctor said he can’t do that. I have said to him that this crime can see him in custody.”

Sheriff Scott Pattison said: “It’s unacceptable behaviour and although your first offence, it’s a significant one.”

Brown was fined £600, payable at £20 per fortnight.
