Assault of cops in Mumbai: Doubts over evidence, 2 get pre-arrest bail

MUMBAI: A sessions court has granted anticipatory bail to two persons, Ushmi Sarvaiya and Utsav Sarvaiya, observing that the evidence on record creates a doubt about their involvement in the assault of cops who questioned a group of five people they had reportedly found drinking in Malabar Hill in the wee hours of October 16 last year.

The two had argued that they had no connection to the crime and had been falsely implicated. The prosecution had sought their custodial interrogation.

The court said while there should be no prejudice caused to free, fair and full probe, there should be no harassment, humiliation and unjustified detention of an accused. It maintained that in the event of any doubt about the genuineness of the prosecution case, an accused is entitled to an order of bail in normal course of events. “The material on record creates doubt about the involvement of the applicants in the said case,” it said.
