According to reports, Sheriff Hathaway traveled to Mexico to interview the prosecution's main witness, a move that has been criticized by Kelly's defense team. The defense consultant, Dr. Ron Martinelli, has called the sheriff's actions prejudicial and biased towards Kelly.

The case revolves around an incident on Kelly's cattle ranch near Nogales, Arizona, where a man was shot and killed. Kelly was initially charged with first-degree murder but the charge was later downgraded to second-degree murder.
