Justice Kagan temporarily blocks Jan. 6 panel's subpoena for Arizona GOP leader's phone records

Justice Elena Kagan granted a temporary stay Wednesday to Arizona Republican Party leader Kelli Ward, who asked the Supreme Court to block a subpoena seeking her phone records in relation to a Jan. 6 select committee investigation.

Driving the news: In an emergency application Wednesday, Ward asked the justice to temporarily block a lower court's decision that requires her cellphone provider to hand over her phone records to the committee.


  • Justice Kagan also ordered a response to the application be given before 5 p.m. ET Friday.

Catch up quick: An appeals court over the weekend rejected Ward's claims that her First Amendment rights would be challenged if investigators uncovered who she spoke to when trying to challenge the 2020 presidential election results, per AP.

  • The subpoena asked T-Mobile to turn over call and text message activity from November 2020 to January 2021.

The big picture: Ward, who posed as a fake elector for former President Trump, refused to answer questions during her own testimony with the panel, Politico reports.

Zoom out: Ward is the latest in a series of other high-level Republicans to appeal to the Supreme Court in recent weeks.

  • Supreme Court Justice Clarence Thomas on Monday temporarily blocked a subpoena from an Atlanta grand jury seeking testimony from Sen. Lindsey Graham (R-S.C.) in an investigation of possible criminal efforts to overturn the 2020 election.
  • Earlier this month, the Supreme Court rejected a petition from Trump, barring the special master in the Mar-a-Lago probe from reviewing classified documents obtained at the former president's Florida residence.
