Angry passenger kicked station staff member after learning he'd missed his train

A rail passenger flew into a rage and kicked a station staff member after learning he'd missed his train.

Rik Bush had gone into the first class lounge at Newcastle Central Station to enquire about his train service but was told he was too late and it had left.

The 61-year-old then lost his temper and became abusive before shouting "If I'm going to get locked up, it might as well be for punching someone," South East Northumberland Magistrates' Court was told.

Bush refused to calm down and, moments later, lashed-out and kicked a staff member in the leg while his back was turned.

Bush, of Ivy Terrace, Shiney Row, Sunderland, was arrested and appeared in court to plead guilty to one count of assault by beating and a public order offence.

Rachael Glover, prosecuting, said Bush had been at the station on September 30 this year when he walked into the first class lounge.

"He's made enquiries about a train and when he finds the train has left he's become abusive towards a staff member," Miss Glover told magistrates.

"The defendant swore at him and made him feel intimidated."

The member of staff then called on another colleague to help and Bush turned his attention towards him, shouting "If I'm going to get locked up, it might as well be for punching someone."

Bush was told that, due to his behaviour, he was not allowed to travel on any rail service that day.

Miss Glover added: "The member of staff then turned away and felt a connection to his leg on the back. He felt the defendant kick him in the leg."

Bush was arrested and, in interview, told officers he had a "long-term injury that stops him having control of his leg", so denied kicking the worker.

However, he later pleaded guilty to the assault in court.

Ian Hudson, defending, said Bush had forked out £200 for a last minute, first class ticket to see his sister in hospital and had lost his temper when he found out he had missed the train.

Mr Hudson said: "It was an emergency situation to see his sister in intensive care. He goes to the platform but doesn't make the train as he's standing at the wrong end. Thats a matter that upsets him."

Magistrates fined Bush £50 and ordered him to pay £50 compensation, £85 costs and a £30 victim surcharge.
