Aldi bringing back Cuthbert the Caterpillar today amid legal row with M&S over Colin

Aldi is bringing back Cuthbert the Caterpillar amid an ongoing legal row with rivl supermarket Marks & Spencer.

The upmarket grocer is suing the discounter over claims its Cuthbert cake is too similar to Colin the Caterpillar.

Marks says the Cuthbert cake infringes its trademark and "rides on the coat-tails" of its reputation, and has now lodged an intellectual property claim with the High Court.

Cuthbert is usually a seasonal product and wasn’t on sale when M&S started the complaint - but now Aldi has brought it back to stores.

The cake is priced at £4.99 and Aldi says all profits from each cake sold will go to Teenage Cancer Trust.

In comparison, Colin the Caterpillar costs £7 from M&S.

M&S says Cuthbert is just too similar to its Colin the Caterpillar cake (PA)

In a cheeky tweet last week, Aldi called Cuthbert “the outlaw” and said he’ll be back in stores due to “popular demand”.

It comes after the grocer launched its tongue-in-cheek #FreeCuthbert campaign on social media, in a string of messages aimed at M&S.

In one tweet, Aldi said: “Hey Marks and Spencer can Colin and Cuthbert be besties?

“We’re bringing back a limited edition Cuthbert and want to donate profits to cancer charities including your partners Macmillan and ours Teenage Cancer Trust. Let’s raise money for charity, not lawyers.”

Responding to their message, M&S replied: Hey Aldi. We love a charity idea (Colin's been a BIG fundraiser for years). We just want you to use your own character.

“How about Kevin the Carrot Cake? That idea's on us... and we promise we won't do Keith.”

In another cheeky tweet, Aldi rebranded M&S as "Marks and Snitches" and poked fun at Marks' adverts by saying: "This is not just any court case, this is..."

To make the return of Cuthbert, the chocolate cake hero was seen taking part in a charity skydive to raise money for Teenage Cancer Trust.

Cuthbert even has a JustGiving page where fans can sponsor his daredevil efforts.

On the page, "Cuthbert" says: "Forty thousand feet: no, it’s not what you get if you add up the number of chocolate caterpillar cakes in the UK – it’s how high up off the ground I just went for my charity skydive.

"And my knees go weak at the thought.

"But a caterpillar’s gotta do what a caterpillar’s gotta do."
