Accused killer, son of COVID patient freed

An accused Melbourne killer has been freed on bail to support his family while their father is in a critical condition in hospital with COVID-19.

Adam Tiba, 22, is charged with the shooting murder of tradie Adrian Pacione after allegedly opening fire on a home in Lalor the victim was visiting in July last year.

Mr Pacione, 20, suffered head injuries and died in hospital two days later.

Following an unsuccessful application earlier this year, Justice Lex Lasry granted bail for Tiba on Wednesday after hearing of his father's "dire" condition.

Tiba's barrister Dermot Dann QC said the family patriarch Zain Tiba had been in a critical condition in a medically induced coma at the Alfred Hospital since September 12.

Tiba's mother and two of his siblings had also contracted the virus.

His mother is now home after a period in hospital but is struggling with her recovery, he said.

"His (father's) situation, very unfortunately, is so much worse," he said.

"He's in a critical condition and the situation, if I can use the expression, is dire."

Tiba's older sister has moved back in with her mother to care for three siblings still at home - the youngest just three.

Mr Dann said nobody in the family was able to visit Mr Tiba in hospital but there was a contingency that if death was imminent family members may be able to attend at the last moment.

"It's a grave situation the family is facing," he said.

Mr Dann said while on bail Tiba also has the chance to continue working for his uncle and hopes to resume a Bachelor of Business which he began before his arrest.

Tiba's co-accused Abdullah Hammoud and Tahmid Rahman have previously been released on bail, with respective sureties of $30,000 and $500,000.

Their case is due back in court next month.
