
The Supreme Court Tuesday upheld the Appeal Court's ruling revoking former defence minister ACM Sukumpol Suwanatat's retroactive order dismissing former prime minister Abhisit Vejajjiva from the army reserve in 2012.
Mr Abhisit's lawyer Bandit Siripan said the court ruled against the order, which it described as "dishonest and unlawful". The court said Mr Abhisit was dismissed retroactively despite no longer serving as a soldier. He had never been probed for a disciplinary breach or suspended from duty.
ACM Sukumpol had no authority to dismiss Mr Abhisit retroactively 23 years after he left military service, based on the Military Disciplinary Act, said the court. ACM Sukumpol on Nov 8, 2012 stripped Mr Abhisit of his rank and army service record on claims he did not go through conscription as required by law.
