A family dispute that turned in to a street fight sees Paisley man ordered to pay compensation

A family dispute which ended up in a street fight has resulted in a Paisley man being ordered to pay £600 in compensation.

Jamie McKim of Tenters Way admitted he assaulted Michael Woods in Paisley’s High Street at its junction with New Street on November 10, 2019.

McKim repeatedly punched Michael Woods causing him to fall and kicked him on the body to his injury.

Procurator fiscal depute Ian Mathieson told Paisley Sheriff Court: “The witness Jordan McKim and complainer Michael Woods were standing at the locus around 2.25am.

“At this time the accused and Lewis McKim were seen walking towards Woods and Jordan McKim in an aggressive manner.

“Witness Lewis McKim and Jordan McKim became involved in a fight.

“Michael Woods, the complainer placed his takeaway on the ground.

“The accused approached Woods and repeatedly punched him causing him to fall to the ground.

“Woods hung on to the accused’s leg and McKim kicked Woods on the body.

“This incident was caught on CCTV.

“Members of the public intervened and stopped the fight.

“Mr Woods returned home and Jordan McKim attended the Royal Alexandra Hospital.

“Police became involved at 2.30pm that day when the witness Jordan McKim’s father reported to police that his son had been assaulted.

“During those enquiries, officers traced CCTV and observed the assault on Woods by Jamie McKim.

“On November 13, Woods attended at the Royal Alexandra Hospital on advice of police where it was confirmed he had concussion but didn’t have any broken or damaged bones, but he did have a black eye.”

Defence agent Mrs McMillan explained the incident was a result of a “family dispute.”

She explained: “Mr McKim was at a family party and when he left he came across the witnesses who are his cousin, his father and a friend.

“The friend of his cousin is Mr Woods.

“There was an exchange of words and in the heat of the moment after consuming alcohol the incident took place.

“He accepts full responsibility and is extremely sorry.

“The family members involved attended at his property the next day to instigate more problems but Jamie McKim closed the door and stated he wanted nothing to do with them.”

Sheriff Gillian Craig said: “I understand it was a family matter that’s spilled over which is unfortunate.”

Sheriff Craig imposed an £800 compensation order reduced to £600 for McKim’s early plea.

McKim was also ordered to pay a £40 victim surcharge.
