The CLARITY Act, the most sweeping crypto regulation Congress has ever advanced, is stuck on the Senate floor. The obstacle isn't Republicans.
It's Democrats who say the ethics language written to win their votes is engineered to let President Trump walk away clean.
Republicans hold 53 seats, and the bill needs 60 to clear the filibuster, meaning at least seven Democrats have to cross over.Right now, none of them have signed on to the new language, and the August recess is closing fast.
What the Ethics Provision Actually Says
Released as part of the 616-page revised text, the provision bars federal officials and their spouses from issuing or sponsoring a new digital asset while in office, with platforms prohibited from listing anything issued in violation.
Officials with existing holdings can comply by using a blind trust or divesting.
The fights are in the fine print. Enforcement rests solely with the DOJ, state attorneys general are barred, and the rule is temporary, sunsetting at the end of Trump's term in January 2029.
Why Democrats Won't Budge
The objection is structural. The provision only touches new issuances, which leaves Trump's existing income streams untouched.
His 2025 disclosures showed crypto income surging to roughly $1.4 billion, including about $636 million from the TRUMP meme coin and more than $500 million from World Liberty Financial. Critics argue it's incoherent to write the rulebook for an industry the sitting president just extracted his single largest income stream from.

Senators Chris Murphy, Chris Van Hollen, and Jeff Merkley have formally opposed the bill, calling it corrupt, with enforcement by a presidentially appointed attorney general and the 2029 sunset amounting, in their view, to retroactive immunity.
The Industry and the White House Push Back
The other side sees a historic concession being squandered. The crypto industry wants this passed badly:

The White House notes the restrictions also cover the vice president, lawmakers, and their spouses, not just Trump. And the stakes of failure are real.
Sen. Cynthia Lummis has warned that if the bill dies in 2026, the process may not restart until 2030, while analysts warn the SEC and CFTC would fill the vacuum with tougher rules.
The procedural math is brutal. The House passed CLARITY 294-134 a year ago, and the Senate Banking Committee cleared it 15-9 in May, but no floor vote has been scheduled.
Majority Leader John Thune conceded it's unlikely to pass before recess and said the Senate needs to see "where the votes are." Senators Gallego and Tillis are reportedly working a counter-proposal on the ethics text, the last realistic path to a vote.
Bitcoin Price Today
Bitcoin is holding around $63,500 on August 4, up about 1.5% on $25 billion in volume, but still below its 50-day average near $66,300 and roughly 49% under its October 2025 record.
The market has mostly stopped pricing CLARITY as imminent, which is why the reaction to each new stall has faded.
So the real question heading into recess: is this a temporary impasse over enforcement details, or the moment America's crypto rulebook dies over the very president who'd be regulated by it?
